implementaci\u00f3n de un sistema de cargue directo de carb\u00f3n en las operaciones que para 2014 adelantaba en la zona portuaria de Santa Marta, la Superintendencia de Puertos y Transporte sancion\u00f3 en d\u00edas pasados a la sociedad portuaria American Port Company Inc., con una multa de $1.802 millones.<\/p>\n<p>El superintendente Javier Jaramillo, en la decisi\u00f3n que resolvi\u00f3 el recurso de apelaci\u00f3n, concluy\u00f3 que esta sociedad \u2013vinculada con la empresa estadounidense Drummond Ltd.\u2013 no atendi\u00f3 las instrucciones que desde 2007, con entrada en vigencia a partir del primero de enero de 2014, exigieron a todos los puertos mar\u00edtimos y fluviales del pa\u00eds para efectuar el cargue de carb\u00f3n a trav\u00e9s de un sistema de cargue directo, mediante bandas transportadoras encapsuladas u otro sistema tecnol\u00f3gico equivalente, esto con el objetivo de mitigar el impacto ambiental que genera dicha actividad.<\/p>\n<p>Seg\u00fan el fallo dado a conocer hoy por la entidad de control, en una visita de inspecci\u00f3n realizada el 2 de enero de 2014 se evidenci\u00f3 que la sociedad portuaria continuaba realizando el cargue de carb\u00f3n a trav\u00e9s de barcazas en zona de fondeo (lugar dentro del mar en el que se hace el cargue y descargue de mercanc\u00edas en una zona portuaria), lo que atenta contra los protocolos establecidos para el correcto transporte del carb\u00f3n en zonas portuarias.<\/p>\n<p>\u201cEl cumplimiento de estas obligaciones no solo tienen un impacto directo en la normatividad que rige la actividad de los puertos, sino tambi\u00e9n en el cuidado del medioambiente, ya que el transporte irregular de este mineral puede producir dispersi\u00f3n de part\u00edculas que afectan el ecosistema marino y la calidad del aire\u201d, agreg\u00f3 el funcionario.<\/p>\n<p>Aunque la sociedad portuaria argument\u00f3 que el incumplimiento se deb\u00eda a una huelga de 54 d\u00edas por parte de los trabajadores de Drummond Ltd., que retras\u00f3 3 meses las obras de construcci\u00f3n de la pasarela y del muelle para el sistema de cargue directo, as\u00ed como de las obras en tierra; la Supertransporte consider\u00f3 que esto no justifica la falta, ya que la sociedad tuvo tiempo suficiente para adecuar sus instalaciones y cumplir con la normatividad
