Llevo y Cuper, por presuntamente facilitar la violaci\u00f3n de normas de transporte.<\/p>\n<p>&nbsp;<\/p>\n<p>Entre los cargos que llevaron al ente de control a tomar esta decisi\u00f3n est\u00e1n la presunta facilitaci\u00f3n de violaci\u00f3n de las normas de transporte, y que al parecer no suministraban informaci\u00f3n clara, veraz y suficiente a los usuarios, entre otras. En caso de ser encontradas responsables, las multas a estas empresas podr\u00edan superar los $8.000 millones de pesos en conjunto<em>.<\/em><\/p>\n<p>&nbsp;<\/p>\n<p>El Superintendente de Transporte, Camilo Pab\u00f3n Almanza, manifest\u00f3 que <em>\u201cestos nuevos casos son determinantes en la lucha de la Superintendencia contra la ilegalidad por varias razones, Por un lado, estamos vinculando empresas extranjeras a investigaciones en Colombia, para que respondan por las posibles infracciones de nuestra legislaci\u00f3n de transporte. Y por otro, por primera vez estamos aplicando el Estatuto de Protecci\u00f3n del Consumidor a dos empresas que estar\u00edan imponiendo cl\u00e1usulas abusivas a los consumidores \u2013 pasajeros. Es una muestra m\u00e1s del compromiso de la Super por la protecci\u00f3n de los usuarios de transporte en el pa\u00eds\u201d.<\/em><\/p>\n<p>&nbsp;<\/p>\n<p>A las empresas Uber Technologies INC, con sede en Estados Unidos; Uber B.V, con sede en los Pa\u00edses Bajos; Rasier Operations B.V., Lieber Colombia S.A.S., Llevo y Cuper, estas dos \u00faltimas dedicadas al mototaxismo, se les imput\u00f3 cargos por presuntamente facilitar la violaci\u00f3n de las siguientes normas de transporte:<\/p>\n<p>&nbsp;<\/p>\n<ol>\n<li>Facilitar la prestaci\u00f3n de transporte con veh\u00edculos que no tendr\u00edan las condiciones t\u00e9cnico mec\u00e1nicas exigidas, ni contar\u00edan con los\u00a0\u00a0\u00a0\u00a0 mantenimientos preventivos y alistamientos diarios exigidos por la ley.<\/li>\n<li>Facilitar la prestaci\u00f3n de transporte con veh\u00edculos que no est\u00e1n homologados\u00a0ni matriculados para servicio p\u00fablico.<\/li>\n<li>Facilitar la prestaci\u00f3n de transporte con conductores que no tendr\u00edan la licencia de conducci\u00f3n\u00a0para transporte p\u00fablico, ni las capacitaciones ni los programas de medicina preventiva requeridos.<\/li>\n<li>Facilitar la prestaci\u00f3n de transporte sin contar con un plan estrat\u00e9gico de seguridad vial.<\/li>\n<li>Facilitar la prestaci\u00f3n de transporte sin contar con los seguros que cubran los riesgos seg\u00fan las exigencias legales.<\/li>\n<li>Facilitar la prestaci\u00f3n de transporte por sujetos que no est\u00e1n constituidos ni habilitados de acuerdo con los requisitos legales.<\/li>\n<li>Por alterar el servicio p\u00fablico, entre otros cargos.<\/li>\n<\/ol>\n<p>&nbsp;<\/p>\n<p>Por su parte, la Delegatura para la Protecci\u00f3n de Usuarios del Sector Transporte de la Supertransporte abri\u00f3 investigaciones administrativas en contra de Lieber Colombia SAS y Maximobility SAS (empresa relacionada con la operaci\u00f3n de la aplicaci\u00f3n Cabify) por presuntamente:<\/p>\n<p>&nbsp;<\/p>\n<ol>\n<li>Incluir dentro de sus \u201ct\u00e9rminos y condiciones\u201d cl\u00e1usulas que podr\u00edan considerarse abusivas, como algunas que limitan tanto el ejercicio de los derechos de los usuarios en materia de reversi\u00f3n del pago y poder acceder a los mecanismos dispuesto por el ordenamiento jur\u00eddico colombiano para proteger sus derechos, como tambi\u00e9n otras que, al limitar la responsabilidad del productor o proveedor, trasladan a los usuarios obligaciones que no deber\u00edan ser asumidos por estos sino por quienes ofrecen el servicio. Un ejemplo es el caso de las posibles responsabilidades a cargo de los usuarios por los da\u00f1os derivados del uso de la plataforma.<\/li>\n<li>Por no suministrar informaci\u00f3n clara, veraz, suficiente, oportuna, verificable, comprensible, precisa e id\u00f3nea a los usuarios sobre los servicios ofrecidos y los canales de atenci\u00f3n dispuestos para presentar PQRS.<\/li>\n<\/ol>\n<p>&nbsp;<\/p>\n<p>La Superintendencia de Transporte respetar\u00e1 el debido proceso y derecho de defensa de las empresas investigadas.<\/p>\n<p>&nbsp;<\/p>\n<p>&nbsp;<\/p>\n<p>De otro lado, la Superintendencia de Transporte impuso una sanci\u00f3n a la Secretar\u00eda de Movilidad de Santiago de Cali porque durante 2019 omiti\u00f3 controlar el transporte ilegal en la ciudad, afectando con ello la prestaci\u00f3n del servicio de manera regular. Se trata de la primera sanci\u00f3n en el pa\u00eds contra un organismo de tr\u00e1nsito municipal por incurrir en omisi\u00f3n de control del transporte ilegal.<\/p>\n<p><strong>\u00a0<\/strong><\/p>\n<p><strong>Sector unido por el transporte legal<\/strong><\/p>\n<p>&nbsp;<\/p>\n<p>Para reforzar el mensaje de legalidad y transparencia en el transporte en todo el territorio nacional, la Direcci\u00f3n de Tr\u00e1nsito y Transporte de la Polic\u00eda Nacional (DITRA) orden\u00f3 a todos los Jefes de las Seccionales del pa\u00eds para que, en ejercicio de sus funciones, elaboren una orden de comparendo por \u201c<em>Conducir un veh\u00edculo que, sin la debida autorizaci\u00f3n, se destine a un servicio diferente de aquel para el cual tiene licencia de tr\u00e1nsito<\/em>\u201d, pr\u00e1ctica que puede llevar a sanciones de cerca de 900.000 pesos; o un informe de infracci\u00f3n al transporte (IUIT) por \u201c<em>realizar operaciones de transporte p\u00fablico sin el cumplimiento de los requisitos legales<\/em>\u201d, lo cual puede generar sanciones de cerca de 700.000.000 por cada infracci\u00f3n.<\/p>\n<p>&nbsp;<\/p>\n<p>El director encargado de la Ditra, Coronel Jos\u00e9 Daniel Gualdr\u00f3n Moreno, manifest\u00f3 que <em>\u201cesta instrucci\u00f3n se emite para incrementar el control en v\u00eda de quienes, en veh\u00edculos particulares, est\u00e9n prestando transporte p\u00fablico. Donde ponen en riesgo la vida y salud de la comunidad y por lo tanto la Polic\u00eda Nacional estar\u00e1 atenta para aplicar las normas de tr\u00e1nsito y de transporte a estos presuntos infractores\u201d.<\/em><\/p>\n<p><em>\u00a0<\/em><\/p>\n<p>Esta instrucci\u00f3n es consistente con lo previsto en la circular externa 015 de 2020 emitida por la Superintendencia de Transporte.<\/p>\n<p>&nbsp;<\/p>\n<p>Vale la pena mencionar que, en lo corrido del a\u00f1o, la Ditra ha impuesto 847 IUIT en diferentes zonas del pa\u00eds por prestar el servicio de transporte p\u00fablico de manera informal.<\/p>\n<p>&nbsp;<\/p>\n<p><strong>\u00a0<\/strong><\/p>\n<p><strong>Decisi\u00f3n de investigaciones<\/strong><\/p>\n<p><strong>\u00a0<\/strong><\/p>\n<p>Se resolvi\u00f3 una apelaci\u00f3n interpuesta por Uber Colombia S.A.S. que, en respeto del debido proceso, se revoc\u00f3 la sanci\u00f3n en segunda instancia.<\/p>\n<p>&nbsp;<\/p>\n<\/div><div class=\"fusion-sep-clear\"><\/div><div class=\"fusion-separator fusion-full-width-sep\" style=\"margin-left: auto;margin-right: auto;margin-top:10px;margin-bottom:10px;width:100%;\"><div class=\"fusion-separator-border sep-double\"
