Como consecuencia de lo anterior, se formularon cargos contra 16 Concesionarios Viales y Contratistas que operan veinticuatro 24 estaciones de pesaje.<\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<ul>\n<li>Desde junio de 2020, la SuperTransporte anunci\u00f3 el inicio de una campa\u00f1a de verificaci\u00f3n de situaciones que afectaran al transporte de carga en Colombia. Esta ya ha arrojado decisiones sin precedentes en el pa\u00eds respecto de Generadores de Carga, Empresas de Transporte, as\u00ed como Concesionarios Viales.<\/li>\n<\/ul>\n<p><strong>\u00a0<\/strong><\/p>\n<p><strong>(@SuperTransporte). <\/strong>La Superintendencia de Transporte, a trav\u00e9s de la Direcci\u00f3n de Promoci\u00f3n y Prevenci\u00f3n de la Delegatura de Concesiones e Infraestructura, adelant\u00f3 acciones de supervisi\u00f3n para verificar el cumplimiento de las normas relacionadas con el control del sobrepeso en carreteras por parte de los administradores de las estaciones de pesaje ubicadas a lo largo del territorio nacional, debido al incremento en el n\u00famero de peticiones, quejas y reclamos recibidas por la Entidad. A partir de las inconsistencias evidenciadas, se encontr\u00f3 m\u00e9rito para abrir investigaci\u00f3n en contra de 16 operadores de 24 estaciones de pesaje por, presuntamente, infringir la normatividad que regula el control al sobrepeso de los veh\u00edculos de transporte de carga de configuraci\u00f3n C2 que transitan por las v\u00edas del territorio nacional.<\/p>\n<p>&nbsp;<\/p>\n<p>Para el Superintendente, Camilo Pab\u00f3n Almanza, \u201c<em>los concesionarios viales y los administradores de las estaciones de pesaje tienen la obligaci\u00f3n de tener actualizados sus registros con la informaci\u00f3n del RUNT y el marco normativo que est\u00e9 vigente. El control del sobrepeso es importante para conservar en buen estado las v\u00edas y reducir la siniestralidad, pero ese control debe cumplir con las normas legales para no causar un perjuicio a los transportadores, quienes, por su parte, tambi\u00e9n est\u00e1n obligados a no excederse en peso al momento de ejercer su actividad\u201d<\/em>.<\/p>\n<p>&nbsp;<\/p>\n<p>Vale la pena recordar que los operadores de las estaciones de pesaje deben realizar el control del sobrepeso en v\u00eda, como una actividad que hace parte de la debida prestaci\u00f3n del servicio. De esta manera, para efectos de concluir si un veh\u00edculo de carga viaja con sobrepeso o no, es obligaci\u00f3n para los administradores de las estaciones de pesaje mantener actualizado su sistema con el marco normativo que regula los m\u00e1ximos pesos para el transporte de carga en Colombia, as\u00ed como con la informaci\u00f3n que reposa en otras entidades, como el RUNT, y ajustar las b\u00e1sculas camioneras con las que, finalmente, se pesan los veh\u00edculos de conformidad con estos par\u00e1metros y rangos. De no ser as\u00ed, el peso que registre el veh\u00edculo de carga al momento del pesaje no podr\u00e1 ser considerado asertivamente como sobrepeso.<\/p>\n<p>&nbsp;<\/p>\n<p>Para la formulaci\u00f3n de cargos, de acuerdo con la informaci\u00f3n recolectada, se identificaron algunas inconsistencias en los Pesos Brutos Vehiculares (PBV) m\u00e1ximos que aparecen registrados en los tiquetes de pesaje los veh\u00edculos de configuraci\u00f3n C2, frente a los PBV m\u00e1ximos registrados en el RUNT y frente a los m\u00e1ximos establecidos por el Ministerio de Transporte, encontr\u00e1ndose los primeros por fuera de los rangos establecidos para tal fin. Sin embargo, hay lugar a que los investigados presenten descargos, de tal manera que se pronuncien sobre los hechos objeto de investigaci\u00f3n y soliciten las pruebas que consideren pertinentes.
