SASPRO desarrollado por la Superintendencia de Transporte es un aplicativo web que facilita el seguimiento y cumplimiento de los protocolos de bioseguridad establecidos por el Gobierno Nacional para enfrentar la coyuntura por el COVID-19 por parte de las terminales de transporte.<\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<ul>\n<li>De encontrarse responsables, las terminales de transporte podr\u00edan ser multadas hasta con 700 salarios m\u00ednimos legales mensuales vigentes, por cada cargo.<\/li>\n<\/ul>\n<p>Por presuntamente no estar cumpliendo con el reporte de informaci\u00f3n para la verificaci\u00f3n de los protocolos de bioseguridad y algunas de las medidas sanitarias, la SuperTransporte abri\u00f3 investigaci\u00f3n y formul\u00f3 pliego de cargos en contra de la Terminal de Transportes del Socorro S.A. y el Centro Empresarial del Transportes Terminal de Quibd\u00f3 S.A.S.<\/p>\n<p>Para el Superintendente de Transporte, Camilo Pab\u00f3n Almanza, <em>\u201cel no suministro de informaci\u00f3n y el incumplimiento de los protocolos de bioseguridad establecidos por el Gobierno Nacional para mitigar la expansi\u00f3n del COVID-19 no solamente pone en riesgo la prestaci\u00f3n de este servicio p\u00fablico esencial para todos los usuarios, sino que compromete la competitividad del pa\u00eds al provocar ineficiencias en la reactivaci\u00f3n econ\u00f3mica\u201d. <\/em><\/p>\n<p>La SuperTransporte realiz\u00f3 diferentes requerimientos a trav\u00e9s de los cuales promovi\u00f3 el acatamiento de los protocolos de bioseguridad, luego de lo cual solicit\u00f3 a los administradores de las terminales de transporte la informaci\u00f3n y los soportes que permitieran supervisar y evidenciar la implementaci\u00f3n de las acciones tendientes a dar cumplimiento -permanente- a las medidas sanitarias ordenadas por las diferentes Autoridades del orden nacional.<\/p>\n<p>Al respecto, la Direcci\u00f3n de Investigaciones de Concesiones e Infraestructura evidenci\u00f3 que el Centro Empresarial de Transportes Terminal de Quibd\u00f3 S.A.S. y la Terminal de Transportes del Socorro S.A.S., presuntamente habr\u00edan desatendido algunos requerimientos de informaci\u00f3n y de implementaci\u00f3n de medidas de bioseguridad, con lo cual no solo se estar\u00eda obstaculizando la labor de supervisi\u00f3n que en este sentido adelanta la SuperTransporte, sino que se compromete el beneficio que esta labor representa para el sector en general y, puntualmente, para las empresas de transporte y para los usuarios de estas terminales de transporte terrestre quienes tienen derecho a recibir un servicio p\u00fablico de transporte seguro y de calidad.\u00a0<\/p>\n<p>Asimismo, se advierte que aun cuando la Superintendencia de Transporte puso a disposici\u00f3n de las terminales de transporte terrestre medios tecnol\u00f3gicos a trav\u00e9s de los cuales pueden suministrar la informaci\u00f3n que, adem\u00e1s de permitirles realizar autogesti\u00f3n y control de cumplimiento de las medidas de bioseguridad, tambi\u00e9n es utilizada por la entidad para realizar la verificaci\u00f3n del cumplimiento de las medidas de bioseguridad exigidas, las mencionadas terminales estar\u00edan incumpliendo con esta obligaci\u00f3n.<\/p>\n<p>En el aplicativo web SASPRO implementado por la Superintendencia de Transporte, las terminales de transporte terrestre automotor de pasajeros habilitadas en el pa\u00eds encuentran, en un solo formulario, las obligaciones que est\u00e1n vigentes en materia de bioseguridad que se deben cumplir para la debida prestaci\u00f3n del servicio p\u00fablico en la infraestructura del transporte. Esto les permite gestionar en l\u00ednea, de forma met\u00f3dica y con seguridad jur\u00eddica, el cumplimiento de las directrices emitidas por el Gobierno Nacional para prevenir y mitigar la expansi\u00f3n del COVID-19.<\/p>\n<p>Por lo anterior, la Superintendencia de Transporte encontr\u00f3 m\u00e9ritos para abrir investigaci\u00f3n y formular pliegos de cargos en contra del Centro Empresarial de Transportes Terminal de Quibd\u00f3 S.A.S. (Choc\u00f3) y la Terminal de Transportes del Socorro S.A.S. (Santander).\u00a0<\/p>\n<p>&nbsp;<\/p>\n<p><strong><u>Los cargos<\/u><\/strong><strong>\u00a0<\/strong><\/p>\n<ul>\n<li>Presuntamente no suministrar la informaci\u00f3n requerida por la Superintendencia de Transporte relacionada con la implementaci\u00f3n y el cumplimiento de los protocolos de bioseguridad.<\/li>\n<li>Presuntamente incurrir en violaci\u00f3n de las normas del transporte establecidas en la Ley.<\/li>\n<\/ul>\n<p><em>\u00a0\u201cCabe aclarar que la apertura de estas investigaciones de ninguna manera suspende para estas terminales de transporte su obligaci\u00f3n de remitir a la Superintendencia la informaci\u00f3n que les ha sido requerida para el correcto ejercicio de sus funciones\u201d,<\/em> aclar\u00f3 Pab\u00f3n Almanza<em>. <\/em><\/p>\n<p>&nbsp;<\/p>\n<p><strong>Posibles sanciones<\/strong><\/p>\n<p>En caso de ser encontradas responsables, las terminales de transporte en menci\u00f3n podr\u00edan ser multadas hasta con setecientos salarios m\u00ednimos mensuales legales vigentes (700 SMMLV), por cada uno de los cargos imputados, sin perjuicio de la adopci\u00f3n de las medidas que se consideren pertinentes para salvaguardar los derechos de los usuarios de las infraestructuras del transporte que pudieron verse afectados con la conducta investigada.<\/p>\n<p>&nbsp;<\/p>\n<p><strong>Recurso<\/strong><\/p>\n<p>En contra de la decisi\u00f3n de apertura de investigaci\u00f3n y formulaci\u00f3n de pliegos de cargos no procede recurso alguno. Se garantizar\u00e1n los principios del debido proceso y el derecho de defensa. Se precisa que el procedimiento sancionatorio iniciado se realizar\u00e1 de conformidad con lo establecido en la ley.<\/p>\n<\/div><div class=\"fusion-sep-clear\"><\/div><div class=\"fusion-separator
