class=\"fusion-text fusion-text-2\"><p><strong>Bogot\u00e1, Julio 09 de 2020.<\/strong><\/p>\n<ul>\n<li>La Superintendencia de Transporte expidi\u00f3 la Circular Externa 009 del 8 de julio de 2020, dirigida a las empresas prestadoras del servicio p\u00fablico de transporte terrestre de pasajeros y a los organismos de tr\u00e1nsito, con el fin de garantizar el cumplimiento de los contratos de transporte durante el Aislamiento Preventivo Obligatorio.<\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<ul>\n<li>La norma establece que las empresas de transporte deben verificar si el municipio de destino tiene restricciones para el ingreso de los veh\u00edculos y si los pasajeros pueden descender en esa jurisdicci\u00f3n, esto para proteger la actividad de los empresarios y los derechos de los usuarios.<\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<ul>\n<li>Esta circular derog\u00f3 la Circular 006 de 2020.<\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<p><strong>(@Supertransporte).<\/strong> Con el prop\u00f3sito de mitigar la situaci\u00f3n de coyuntura por la que atraviesa el sector para enfrentar el COVID-19 y para proteger los derechos de los usuarios, la Superintendencia de Transporte expidi\u00f3 la Circular Externa 009 del 8 de julio de 2020, la cual establece que las empresas que prestan el servicio de transporte terrestre de pasajeros deben garantizar el cumplimiento de los contratos durante el Aislamiento Preventivo Obligatorio.<\/p>\n<p>La norma pretende mitigar el riesgo de que a los veh\u00edculos de servicio p\u00fablico no se les permita el ingreso a los distintos municipios que cuentan con restricciones, situaci\u00f3n que puede generar un detrimento en las empresas y, a la vez, vulnerar los derechos de los usuarios que viajan bajo alguna de las excepciones y no pueden llegar a sus destinos.<\/p>\n<p>Por esta raz\u00f3n, la Circular Externa 009 indica que las empresas de transporte deben garantizar que podr\u00e1n cumplir el contrato de transporte, para lo cual verificar\u00e1n si en el municipio de destino existe alguna restricci\u00f3n para que (i) el veh\u00edculo pueda ingresar y\/o (ii) los pasajeros puedan descender.<\/p>\n<p>Seg\u00fan el Superintendente de Transporte, Camilo Pab\u00f3n Almanza, \u201c<em>continuamos trabajando de la mano con el sector privado para tomar las mejores decisiones en esta \u00e9poca de pandemia. La circular 9 de 2020 se construy\u00f3 atendiendo las observaciones y preocupaciones de empresarios, conductores y usuarios, velando por el inter\u00e9s general<\/em><em>\u201d.<\/em><\/p>\n<p>En esa medida, se beneficia a todas las empresas de servicio p\u00fablico de transporte terrestre automotor de pasajeros por carretera y las empresas de servicio p\u00fablico de transporte terrestre automotor especial y mixto debidamente habilitadas, as\u00ed como a los usuarios del servicio que necesitan movilizarse durante el periodo de aislamiento preventivo obligatorio.<\/p>\n<p>Es importante aclarar que esta circular sustituy\u00f3 y dej\u00f3 sin efectos la circular 6 de 2020, previamente expedida por esta Superintendencia.<\/p>\n<\/div><div class=\"fusion-sep-clear\"><\/div><div
